To secure your booking you should complete and sign the Ostrich Holidays & Travel Booking Form and send it to your Travel Agent with a 15% non-refundable deposit per person of the applicable rates and 30% deposit to the Company Bank Account if booking is made direct to us (transfer charges are to be paid by the agent or client.)

a) Acceptance by the Company of the booking shall be evidenced by the forwarding to the passenger or his Agent of an Invoice, indicating an amount due and/or owing by the passenger to the Company and the document shall constitute the contract.

b) All monies paid by you to a Travel Agent under or in contemplation of this contract will be held by the Travel Agent for the Company until such monies are transferred to the Company. The balance is due two months (60) days in advance for Overseas bookings and one month(30) days in advance for local bookings.

NB: Confirmation received less than (5) five weeks then full payment should be sent by Bank Telegraphic transfer in our Bank Account in order to facilitate prompt settlement of Hotels and Lodges reservations and other facilities.

1. ROLE OF OSTRICH HOLIDAY & TRAVEL LIMITED.

Our role is to put together Tours and itineraries to fit in with your particular requirements. In many cases the accommodation and Transport provided is owned by us. In some cases we may use reputable independent supplier for the provision of various services. Whatever the case, we accept responsibility for the proper performance of your contract with us  subject to the following booking conditions which form the basis of that contract.

2.  Ostrich Holidays & Travel Limited and its associated Companies is hereinafter referred, to as the Company’s and the passenger is hereinafter referred to as the Passenger.

a) If you arrange your holiday direct with the Company all correspondence and other communications will be sent to the address of the first person named in the booking unless you specify otherwise.

b) If your booking is made through a Travel Agent the Company will address all correspondence to the Travel Agent.

c) The Company reserves the right to notify you of an increase in the Website vis a vis Brochure advertised rates resulting from governmental levies and other incidentals. After a confirmation Invoice has been issued unless you pay your holiday in full at the time of booking in which case your holiday price will be fixed at the cost quoted by the Company at that time.

d) If a surcharge would increase the total holiday price shown on your original confirmation Invoice by (10 – 15%) you may cancel your booking within 14 days of the date of issue of the revised Invoice and obtain a full refund of all payments made to the Company.

3. INSURANCE.

One of the greatest attractions of Africa is the wild and untamed nature of the continent. Every precaution is taken to ensure our clients remain safe. Care must be taken by the clients to ensure that they have taken Travel insurance to cover for personal accident, medical, emergency travel expenses and cancellations.

4.TARIFF.

a) All prices in this Website vis a vis our Brochure are based upon costs as at January 2015 and are subject to change due to government levies from time to time without notice. (Download our Brochure)

b) Rate Includes all expenses in connection with Transport and Driver Guide, Hotel and Lodges accommodation with board table d’hote Meals whilst on safari, government hotel taxes, hotel service charges, Game trips, Park entry visitation fees and all camping facilities in case of camping safari.

c)  Rates are Excludes hotel expenses prior to the commencement of the tour, visa fees, vaccinations, International and local flight tickets unless indicated, Insurance, Airport departure fees, Tips and all items of personal nature.

d) ITINERARIES.

All our itineraries in this Site are intended as a guide only. Flexible/ suitable Itineraries may be prepared as per clients wishes and demands.

e) GROUP TOURS. 

We highly recommend a minimum number of (2 to 5 persons) for a group safari in order for a tour to be financially viable and to have a pleasant group atmosphere. In the event that adequate number of bookings is not achieved, it may be necessary to cancel/curtail a schedule departure and to offer the nearest possible alternative date.

5. ACKNOWLEDGEMENT. 

a) The Passenger acknowledges that it is his/her responsibility to ensure that he/she is possessed of the necessary travel documents that may be required in respect of the proposed tour and itinerary, as well as all health and other certificates that may be required from time to time.

b) Even though the Company will endeavor to assist the passenger in this regard, such assistance to be at the Company, sole discretion, the passenger acknowledges that in doing so, the Company is not assuming any obligation or liability, and that nevertheless the responsibility to ensure that the aforesaid documentation is in order and complies with such lawful and other requirements to enable the passenger to enjoy the benefits of the tour, remains the Passenger’s responsibility.

6.CANCELLATIONS.

a) by you.

Should you need to cancel your booking you  must notify us immediately in writing. In this eventuality your Deposit  is non refundable. Should notification of cancellation be received by us 21 days or less before the commencement date of your Tour a cancellation fee of 50% of the Total cost of you holiday arrangements will be payable, and in case of notification given  7 days or less prior to commencement the tour cancellation charge will be 100% of the total cost.

b) by us.

Although it rarely happens and we shall do our utmost to avoid doing so, we must reserve the right to cancel Tours and other arrangements. Where your holiday is cancelled (other than due to your default in payment, we will offer you the choice of an alternative holiday and paying a refund in respect of any price difference.

Very rarely we may be forced to curtail your Holiday after departure. In this case we regret we cannot make any refund or pay any compensation, or be responsible for any cost or expenses incurred by you as a result.

7. Changes By You.

a) Should you wish to make any changes to the arrangements we have made on your behalf, we will endeavor to assist. An amendment fee of US $ 25.00 per person will be payable.

b) Changes By Us.

We reserve the right to make changes to brochure details and holiday arrangements both before and after you have booked you holiday. Mostly changes are always minor. In the event of a significant change we will inform you or your Agent at the earliest possible time. In this case you have the choice of either accepting the change or booking alternative arrangements and Paying or Receiving a refund in respect of any price difference of canceling. your holiday and receiving a full and immediate refund of all monies paid in advance.

8. LIABILITY.

a) Quality.

We accept responsibility should the services which we are contractually obliged to provide prove deficient or not of a reasonable standard due to defaults of our employees, suppliers and sub-contractors.

b) CARRIERS.

Please note, our responsibility and obligations apply in respect of those service which we agree to arrange or provide on your behalf. We cannot accept any liability any services which you arrange in conjunction with our own. By way of example, we cannot accept any liability if for whatever reason you are not at the correct departure point at the correct time at the beginning of any Tour or Itinerary and as a result you miss the departure.

9. FORCE MAJEURE.

a)  Ostrich Holidays Travel must normally make substantial payments to its suppliers (Hotels, Camps, National Parks, Transportation companies ( etc.) far in advance of the scheduled embarkation date. If a trip is canceled due to force majeure (acts of God, war, labor strikes, earthquake, flooding (etc.), Ostrich Holidays & Travel will promptly refund the portion of the trip cost not already advanced to suppliers and use its best efforts to recover and refund the balance as promptly as possible. However, Ostrich Holidays & Travel does not guarantee recovery of any or all of the advance payments made, and our use of best efforts to recover these payments will not include the institution of any legal proceedings in foreign jurisdictions.  Ostrich Holidays & Travel is not responsible for expenses incurred by trip members in preparing for a canceled trip (e.g.) nonrefundable advance purchase air tickets, visa fees, inoculations,  equipment (etc.) or for any additional arrangements should the trip member have embarked prior to the scheduled departure date.

b)  Ostrich Holidays Travel Limited believes that the contents of this website is correct as it is to-date, but all prices and services described herein are subject to change or withdrawal without notice.

c)  It is important to note that during the course of the tour, weather; road conditions; vehicle mechanical breakdowns or any other unforeseen reasons beyond the control of Ostrich Holidays and Travel.

Holidays & Travel Limited, can influence the performance of a tour. Although delays are rare, considering some African touring conditions, the policy in such an event is to provide free of charge, the vehicle, all camping equipment and crew services.

NB: Personal expenses, meals, alternative accommodation and all resulting costs, including the cost of flying home, are to be borne by the passenger. We strongly recommend that

passengers take out travel insurance.

10. COMPLAINTS.

We sincerely hope you will not encounter any problems during your holiday. However, should one arise please immediately advice both our local representative and the supplier of the services in question (e.g.) Hotel/Tented Camps as most problems can be resolved straight away. In the unlikely event of you remaining dissatisfied please write to us setting out your complaint in detail within 28 days of the end of your holiday and obtain a written report form. We regret if you fail to follow this simple procedure we cannot accept responsibility for any complaints which are not notified entirely in accordance with this clause as we have been deprived of the opportunity to investigate and rectify the problem.

11. SPECIAL REQUESTS.

Any special request (e.g.) for single rooms or particular diet must be notified in writing when the booking is made whilst we will endeavor to meet such requests they cannot be guaranteed and any failure to comply will not be breach of contract.

12. SAFARI PARTICIPATION.

The degree of satisfaction and enjoyment you feel at the end of each day and the end of the trip will depend entirely on your capacity to enjoy yourself. This capacity combined with active participation is essential on all trips and Everyone is expected to help with day to day Chores – Routine task to ensure the smooth running of the Tour because of the Mere Nature of the Parameters in which we have to operate.

13. LUGGAGE ALLOWANCE.

a)   Luggage on all our Tours will be strictly limited to one large bag, suitcase or Backpack weighing a maximum of 15 – 20 kg and a smaller hand Luggage or Camera bag per person, in order to prevent complications on vehicles, Airplane’s and Boats this allowance must be adhered to NB. City Hotels normally provides storage facilities on request free of charge.

b) The Company shall be entitled to refuse to carry any baggage in excess of the aforesaid.

14.  LOSS & DAMAGE. 

a) The Passenger acknowledges that there are dangers and risks inherent in the tour which they will be undertaking and;

b) The Passenger agrees to assume all the risks connected with or arising out of all aspects of the tour and;

c) The Passenger warrants that they are over 21 (twenty one) years of age.

15. SPENDING MONEY.

Each trip will require differing amounts of pocket money depending on the length of the journey, the individual needs and specific conditions of each Tour. Money is needed for Tips,

Telephone, Curios, Alcohol and soft drinks and any additional excursions not included in the Tour.

16. AIR TRANSPORT.

Ostrich Holidays & Travel Ltd. will assist with any flight bookings and arrangements if requested. We will always endeavor to obtain the best prices possible, but we accept no liability regarding delays, cancellations or any other problems in this regard whatsoever. Passengers tickets in use by the specific Airline when issued shall Constitutes the sole contract between the Airline and the passenger.

17. Flying Doctor Service:

All clients booking safaris in Tanzania Kenya and Uganda are automatically covered by the Flying Doctors Emergency Evacuation Service to Nairobi on purchase of US $. 30 Voucher before start of Safari. We assist in this respect, but medical bills have to be settled direct by the client.

18. Legal Forum, Choice of Laws & Official Language:

This offering is a contract between you the buyer, Agent or Client and our Company, the provider of the services. The provider is located in Arusha Town Tanzania’s Northern Tourist hub in East Africa Region. By doing business with us you agree that this offering is made from Arusha the United Republic of Tanzania and shall be governed by the laws of the United

Republic of Tanzania. By electing to participate in this offer, you are entering into a Contract.

The Agreement shall be governed by and construed in accordance with the laws of the United Republic of Tanzania without regard to its conflict of law rules. Any legal action arising out of this Agreement shall be litigated and enforced under the laws of the United Republic of Tanzania. In addition, you agree to submit to the jurisdiction of the Courts of the United Republic of Tanzania, and that any legal action pursued by you shall be within the exclusive jurisdiction of the Courts of Tanzania.

The terms constituting this offering are set forth in writing on our website vis-à-vis our printed brochure materials. You hereby agree to submit to the jurisdiction of the United Republic of Tanzania Courts located in Arusha to resolve any disputes or litigation here under. Whether or not you choose to print this offering, containing the terms and conditions as described herein you agree that this contract constitutes a writing.

The agreement is being written in English, which is the official language of the contracts text and interpretation. If you do not agree with the above terms and conditions, you have the option to not participate in any of our  offers.
